Terms of Service for AudioDiary

1. Acceptance of Terms

By accessing or using the AudioDiary app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.

2. Description of Service

AudioDiary is a multi-platform app (iOS, Android, web, macOS) operated by Soliloquy Apps Limited, enabling users to record audio entries, optionally upload mood data or text, and receive transcriptions and insights powered by OpenAI's Whisper and ChatGPT technologies.

3. Eligibility

You must be at least 16 years old to use AudioDiary. By using the Service, you represent and warrant that you meet this requirement.

4. User Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

5. User Content

  • You retain all rights to your audio entries, mood data, and text.
  • By submitting content, you grant us the right to process it solely to provide and improve the Service.
  • You agree not to upload content that is unlawful, harmful, or violates the rights of others.

6. Payment and Subscription

AudioDiary is a paid service. Subscriptions are billed on a recurring basis unless canceled. You may cancel at any time, but refunds are not guaranteed.

7. Data Usage

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to reverse engineer or interfere with the Service.
  • Transmit viruses, spam, or other disruptive content.

9. Termination

We reserve the right to suspend or terminate your access if you violate these Terms or misuse the Service.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes indicates your acceptance of the new Terms.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be error-free or uninterrupted.

12. Limitation of Liability

To the maximum extent permitted by law, Soliloquy Apps Limited shall not be liable for any indirect or consequential damages arising from your use of the Service.

13. Governing Law

These Terms are governed by the laws of Ireland. If you are a consumer, this choice does not deprive you of any mandatory protections under the laws of the country where you habitually reside.

The courts of Ireland have non-exclusive jurisdiction over disputes arising from these Terms. This does not limit any mandatory right you have as a consumer to bring proceedings in the courts where you live, or any requirement that proceedings against you be brought there.
